PROBATE AND ESTATE ADMINISTRATION
Probate is the process of legally establishing the validity of a Will in Surrogate's Court. The Executor is the person responsible for carrying out the terms of the Will. In order for the Executor to act, the Will must be admitted to probate. In New York, the probate process is generally not as difficult as it is in many states. If a person dies without a Will, the court process is called an Administration. The Administrator must distribute the assets according to New York intestacy laws.
Whether you have been named as an Executor or your loved one did not have a Last Will & Testament, the Law Office of Andrea P. Mottola can help you obtain appointment as the Executor or Administrator, settle debts, distribute assets and explain all of your legal rights.
